1. USE OF OUR WEBSITE

These terms and conditions describe the rules and regulations for using Sara Felgueiras' website, VAT number 227568109, located at felgsara.com, with the email address hey@felgsara.com.

By using our website and placing orders through it, the Buyer agrees to:

  1. Not place fraudulent or false orders;

The Buyer declares to be over 18 years old and legally capable of entering into contracts.

2. SERVICE AVAILABILITY

The items offered on this website will be shipped to all countries. Shipping costs, including customs duties when applicable, will be borne by the buyer.

3. CONTRACT FORMATION

The information on our website constitutes an invitation to treat.

A purchase and sale contract for a product will be concluded when your order is accepted by us. If your order is rejected, but a charge has been made to your account, we will refund the mentioned amount.

Ownership of the products will be transferred to the buyer upon full payment of the price.

4. PRODUCT AVAILABILITY

All orders for products are subject to availability. If there are difficulties in the supply of products or they are unavailable, we will contact you immediately. If payment has been made, we will refund the amount within 30 days.

5. SHIPPING

Orders will be shipped via CTT. On the Checkout page, shipping options will be provided based on the estimated weight of the entire order. The Buyer must choose the preferred option. Sara Felgueiras will respect the option indicated by the Buyer, except in cases where the order exceeds 2kg, due to packaging, and must be sent necessarily as a Postal Order or CTT Expresso. In these cases, the sender is responsible for any extra costs that the shipment may incur.

The order is processed within 5 working days after receiving the payment.

6. DELIVERY

The order will be delivered within 2 to 5 working days when the destination is Portugal, 5 to 15 working days when the destination is Europe, and 10 to 30 days when the destination is the rest of the world.

It is advised that, if it becomes impossible to meet the delivery date within the specified periods due to reasons beyond our control, the Buyer will be informed of this situation. The Buyer can proceed with the purchase or cancel the order with a full refund. 

Once the order is shipped, no changes can be made to the name, address, phone number and/or email provided by the Buyer. Any delay in shipping is beyond our responsibility, and the amount paid for the order cannot be refunded, even if the product does not arrive on time for the specific purpose the Buyer intended (ex: birthday gift).

7. TRANSFER OF RISK AND OWNERSHIP OF PRODUCTS

The risks associated with the product are the responsibility of the Buyer from the moment of delivery.

8. PRICE AND PAYMENT

The price of the products will be as stipulated on our website, except in the case of an obvious error.

Despite our efforts to ensure that the prices on our website are correct, errors may occur. If an error is detected in the price of any ordered product, the Buyer will be informed as soon as possible, and the Buyer will have the option to confirm the order at the correct price or cancel it. If it is not possible to contact the Buyer, the order will be considered cancelled, and a full refund will be issued.

We are not obligated to supply any product at the incorrect lower price (even if the Shipping Confirmation has already been sent to the Buyer) if the pricing error is obvious and unequivocal and could have been recognized by the Buyer.

Prices on the website include VAT but exclude delivery charges, which are added to the total price in the shopping cart.

Prices may be changed at any time. Changes will not affect orders for which an Order Confirmation has been sent.

In the event that the Buyer is not available to open the door, inadvertently provides an incorrect address, or in any other case of the Buyer's responsibility as indicated by the postal service, which compromises the effective delivery of the order, it will be returned to the sender. The department responsible for the company will send a photograph of the returned package, requesting that the shipping cost be paid again. If the Buyer expresses that they do not want the merchandise and if it is in perfect condition, the amount for the products will be refunded. If the Buyer does not respond to our email within 30 days, a new shipment of the order cannot be requested, and the entire amount paid for it, as well as the products, will become the property of Sara Felgueiras.

9. EXCHANGE AND RETURN POLICY
I. I. RIGHT OF FREE CONTRACT RESOLUTION

 When entering into a contract as a consumer, the Buyer has the legally established right to terminate the contract within 14 days after its conclusion, without having to provide any reason for their decision and without incurring any costs. The right of free resolution expires 14 days after the date on which the Buyer, or a third party designated by them, receives the goods in hand. In the case of multiple goods delivered separately, the right of free resolution expires after 14 days from the date on which the Buyer, or a third party designated by them (other than the carrier), receives the last product in the order.

To exercise the right of the free resolution of the contract, the Buyer must contact us, informing us of their decision to terminate the contract through an unequivocal statement to be sent to the email hey@felgsara.com.

Effects of the free resolution of the contract: upon terminating this contract, the Buyer will be entitled to a refund of the amount paid for the products (excluding shipping costs and any customs fees paid directly to the tax authorities of their country), within a maximum period of 14 days from the day we receive the returned products. The refund will be made using the same payment method used in the initial purchase.

The refund amount will be withheld until the return of the goods, which must be sent back in the same packaging and with a degree of packaging similar to the original, so as not to jeopardize the integrity of the products.

II. II. DEFECTIVE PRODUCTS

In cases where the Buyer considers, at the time of delivery, that the product does not comply with the terms of the contract, they must contact Sara Felgueiras within 30 days.

As legally established, instead of denouncing the contract (and consequent return of the goods and refund), the Buyer can also opt for the replacement of the product or an appropriate reduction in price. The refund, product replacement, or appropriate price reduction will be made as soon as possible and, in any case, within a maximum period of 30 days after the consumer requests the replacement of the conformity of the goods.

Variations that should not be considered defects: Products sold, especially handmade and manually produced products, often have the characteristics of the natural materials used in their production. These features, such as variations in grain, texture, knots, and color, will not be considered as defects or damages. Sara Felgueiras selects only products of the highest quality, but natural characteristics are inevitable and should be accepted as part of the individual aspect of the product.

Sara Felgueiras cannot be held responsible for any alleged non-compliance or delay in fulfilling obligations under a Contract when caused by force majeure.

Force majeure includes any act, event, failure, omission, or accident beyond our control, including, among others:

1. General strike or other forms of protest that significantly affect the country.

2. Disturbances of public order, riots, invasions, terrorist attacks or threats, war (declared or not), or threat or preparation for war.

3. Fire, explosion, storm, floods, earthquakes, collapse, epidemic, or any other type of natural disaster.

4. Inability to use trains, ships, planes, motorized transport, or any other means of transport, public or private.

5. Inability to use public or private notification systems.

Our obligations under the Contracts will be considered suspended during the period in which the force majeure situation remains in effect. An extension of the deadline for fulfilling these obligations will be granted for a period equal to the duration of the force majeure situation. We will use all possible means to end the force majeure situation or to find a solution that allows us to fulfill our obligations under the contract, despite the force majeure situation.

11. WAIVER

The fact that Sara Felgueiras does not require, at a particular moment, strict compliance by the customer with any of the obligations assumed within a Contract or these Conditions, as well as the failure on our part to exercise the rights or actions due, does not imply a waiver or should be understood as any limitation to those rights or actions, nor will it exempt the customer from fulfilling their obligations. If, at any time, Sara Felgueiras refrains from enforcing a specific right or action, this will never imply or be understood as a waiver of its rights or actions derived from the Contract or the Conditions. Therefore, any abstention on our part from any of these Conditions, as well as the non-exercise of our rights, will never produce the effects of a waiver unless expressly stated, formalized, and communicated to the customer in writing.

12. PARTIAL REVOCATION

If any of these conditions or provisions of a contract is declared null and void by a binding decision of a competent authority, the remaining terms and conditions will remain in force without being affected by the declaration of nullity in question, thus resulting in the reduction of the conditions and the contract.

13. RIGHT TO UNILATERAL AMENDMENT OF CONTRACTUAL CONDITIONS

Sara Felgueiras reserves the right to review and modify these conditions at any time. The consumer is subject to the policies and conditions in force at the time of using this website or placing an order, except when, by law, it is necessary to make retroactive changes. In that case, any introduced changes may affect previously placed orders.
